How does waste brokering work?

A company that manages the recovery or disposal of waste on behalf of other companies, without physically owning them, performs an intermediary role.
On the one hand, this intermediary establishes business relations with waste recovery and disposal facilities; on the other hand, it assists waste producers in finding the optimal solutions for their management, considering the best technical and economic conditions on the market.

The producer or holder of the waste is legally defined as the principal, while the intermediary assumes the role of agent, operating ‘in his own right, but on behalf of third parties’.
When the intermediary also transports the waste to its final destination, his activity takes on a holding dimension.
However, if the intermediary entrusts the transport to a third party, limiting himself only to brokering, one speaks of a waste brokering activity without possession.

What is a broker without possession?

The broker without possession of waste, who may also be identified as a procurer, establishes business relations with several recovery and/or disposal facilities. This enables producers to identify a suitable facility for the recovery or disposal of their waste.

The intermediary is required to exercise a duty of supervision and control to verify that the person in charge of waste disposal possesses the necessary authorisations and qualifications, since, as established by Legislative Decree No. 152 of 2006, Article 183, Paragraph 1, Letter l, the activity of intermediation, although without holding the waste, falls within the scope of waste management. This responsibility derives from the principle of shared responsibility in waste management, which involves all parties involved in the production, holding, transport and disposal of waste. These actors are vested with a guarantee role to ensure the proper disposal of waste.
